Turk Blogs Terms & Conditions

WHEREAS Verdict Solutions has provided a Turk Blogs product designed to facilitate the creation of website pages by end-users;
AND WHEREAS end user customers agree as follows


1. DEFINITIONS
(a) "Blog Site" means the website created by the Customer using the Turk Blogs product;
(b) "Turk Blogs" and "Service" mean the web content management service provided by Verdict Solutions;
(c) "Confidential Information" means the product information, software, API and all other related data, information protocols, reference implementation and documentation, functional and interface specifications and any other information exchanged between Verdict Solutions and we pursuant to this agreement unless such information is expressly stated to be non confidential or intended for public distribution;
(d) "Content" means the material posted on the Blog Site;
(e) "Customer" means the Turk Blogs end user publishers;
(f) "Effective Date" shall mean the date we accepted the Agreement as recorded on Verdict Solutions logs;
(g) "Fee(s)" mean the monies payable for Turk Blogs in accordance with Section 3 herein;
(h) "Guest" means those persons to whom the Customer has granted access to visit or comment on a Blog Site;
(i) "Term" has the meaning outlined in Section 4 of this Agreement;


End Users CONDITIONS
1. Customers shall not:

a) upload, post, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable or harms minors in any way;

b) forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through Turk Blogs; upload, post or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

c) upload, post or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party;

d) upload, post, or transmit unsolicited commercial email or "spam". This includes unethical marketing, advertising, or any other practice that is in any way connected with "spam", such as (a) sending mass email to recipients who haven't requested email from you or with a fake return address, (b) promoting a site with inappropriate links, titles, descriptions, or (c) promoting your site by posting multiple submissions in public forums that are identical;

e) upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
f) interfere with or disrupt the Turk Blogs service or servers or networks connected to Turk Blogs or disobey any requirements, procedures, policies or regulations of networks connected to the Turk Blogs service;

g) intentionally or unintentionally violate any applicable local, state, national or international law;

h) promote or provide instructional information about illegal activities, harass any group or individual, or promote any act of cruelty to animals;

i) offer for sale or sell any item, good or service that (a) violates any applicable federal, state, or local law or regulation, (b) you do not have full power and authority under all relevant laws and regulations to offer and sell, including all necessary licenses and authorizations, or (c) we determines, in its sole discretion, is inappropriate for sale through the Service provided by we;
j) exceed the scope of the service that you have signed up for; for example, accessing and using tools that you do not have a right to use, or deleting, adding to, or otherwise changing other peoples comments or content as a Guest.

Transfer upgrades can be purchased as "hard" or "soft" upgrades. Hard upgrades are considered to be permanent additions to a customer's subscription and soft upgrades are only applicable for each month (i.e. - they expire at the end of the month and the customer reverts back to the sum of the transfer units that they have subscribed to.) This allows customers who have exceeded their allotment to purchase temporary upgrades specific to that month in the event that they exceed their quota but do not believe that they need to permanently upgrade their quote. Transfer units are not pro-rated.
